Car place failed to refill oil during an oil change and car engine blew. There is video proof. Should we sue?

Our car broke down last week and after towing it to our mechanic we discovered that the rod and shot through the block because there was NO oil in the car. The mechanic said it was ';bone dry';. Well this comes as a surprise as it had been less than two weeks since or oil had been changed. I get in contact with the owner of the place that changed our oil and he says that indeed there was no oil in the vehicle andn that he has video that clearly shows that the employee did not put oil back in our vehicle.





So heres the thing, this is my husbands car which is a '92 Toyota Camry that was owned by a mechanic previous to us. This car ran so well and we never had any problems with it. The owner offered to replace the engine or we can take $1000. This does not seem fair to me considering all of the stress that it has caused us along with all the stress to come with purchasing a new vehicle, licensing, insurance, etc. at a very unexpected time for us.

sue for what? If they are offering to replace the damaged motor, what more do you want? Quit trying to get rich off of a mistake. It happens and they are taking responsibility. I would go for a replacement engine and some money towards the inconvenience %26amp; stress.





If you go to court it would be 50/50 as the garage has accepted responsibility and made an offer!
The shop has offered to correct their mistake you should let them put in a new engine. the retainer fee on a good lawyer is probaly more than the car is worth
I do ont think you will be able to obtain the Video so here it is, I would get a lawyer and yes sue.
Well I think that you should only take it to court after talking to your lawyer. It might not be worth it after all of the lawyer fees, time, stress, and possible little pay out. I definitely think that shouldn't take the $1000. A new engine might be okay if you want it all settled and no hassle. Think about it though and speak to your lawyer before making any final decisions. -- You never know, he might be able to get you alot of money.





(My concern would be what I would be putting the owner through suing even though it wasn't him who didn't put in the oil. It was the employee who should have to pay. Although I am sure that he was fired. Maybe this is what is making you question whether to settle or not?)
